By completing registration and payment for participation in NIRVANA’s 2026 Carnival Experience, you acknowledge and agree to the following Terms and Conditions. This is a legally binding agreement between you and NIRVANA.

1. Your NIRVANA package includes but is not limited to: costume, meals, alcoholic and non-alcoholic beverages, private security, mobile restrooms, and medical services on 10 & 11 August 2026.

2. All payments made to NIRVANA are final, non-refundable, and non-transferable.
This includes deposits, partial payments, and balances. Once a purchase is made, it cannot be refunded, exchanged, or transferred to another individual, section, or year—even in cases of:
• Inability to participate
• Dissatisfaction with costume or service
• Event postponement, modification, or cancellation

3. Final balances must be paid in full prior to distribution. Failure to complete payment by the stated deadline will result in automatic forfeiture of your order without refund.

4. All NIRVANA costumes are custom-produced. Minor variations in color, material, embellishments, or construction are normal and do not constitute defects.
NIRVANA is not liable for natural wear, shedding, or damage that occurs during transport, fitting, or participation.

5. Costumes must be collected during the advertised collection period unless prior written arrangements are approved by the band.
• Costumes not collected by the end of distribution will be considered forfeited.
• All payments will be forfeited, and NIRVANA reserves the right to resell any uncollected costumes.
• No shipping, delivery, or courier services will be provided.

6. The individual collecting a costume must present:
• The original credit card used for purchase
• A valid government-issued ID matching the cardholder’s name

7. By submitting payment, you acknowledge that all transactions are final and non-disputable except in cases of proven fraud.
You agree to:
• Not initiate a chargeback or payment dispute with your financial institution for non-fraudulent transactions.
• Contact NIRVANA first via email at info@nirvanaempire.com to attempt resolution before escalating to your bank or payment provider.
If a chargeback is filed and determined to be fraudulent or unjustified:
• The masquerader will be permanently banned from future NIRVANA events.
• NIRVANA reserves the right to pursue legal action and damages related to the chargeback.

8. Participation in carnival involves inherent risks, including but not limited to personal injury, property loss, or exposure to unpredictable circumstances.
By participating, you voluntarily assume all risks and agree to release, indemnify, and hold harmless NIRVANA, its affiliates, and staff from any claims or damages arising from participation.

9. NIRVANA is not responsible for cancellations or modifications due to events beyond its control (“Force Majeure Events”), including but not limited to natural disasters, extreme weather, acts of war, pandemics, or government restrictions.
• No refunds or compensation will be issued in such cases.
• NIRVANA will make reasonable efforts to adjust or reschedule, but alternative arrangements are not guaranteed.
• By registering, you waive any claim for refund or damages arising from Force Majeure Events.
10. NIRVANA enforces a zero-tolerance policy for violence, harassment, or misconduct. Any masquerader found in violation may be removed from the event without refund and banned from future participation.
